Welcome to Birdey! These Terms of Service ("Terms") govern your use of the Birdey mobile application ("App") operated by Bird's Odyssey ("we", "us", "our"). By downloading, installing, or using Birdey you agree to be bound by these Terms.
1. Eligibility
Birdey is designed for users of all ages. Users under the age of 18 must have the consent of a parent or legal guardian to create an account. A parent or guardian should mark the account as a child account during signup, which enables Kids Mode with a parental gate restricting access to purchases and settings. By using the App you represent that you have the necessary consent.
2. Account
- You may sign in using Google Sign-In, Apple Sign-In, or email/password.
- You are responsible for keeping your login credentials secure.
- You may choose a unique Birdey username. Usernames must not contain profanity, impersonate others, or violate any applicable law.
- We reserve the right to suspend or delete accounts that violate these Terms.
3. Birdey Pro Subscription
- Birdey offers optional paid subscriptions ("Birdey Pro") that unlock additional features such as unlimited booster packs and exclusive content.
- Subscriptions are billed through the Apple App Store or Google Play Store according to the subscription plan you select.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- You may manage or cancel your subscription in your device's store settings.
- Refunds are handled by Apple or Google in accordance with their respective refund policies.
4. Gifts, Virtual Items & Feathers
You may gift a Birdey Pro subscription to another user. Gifted subscriptions are non-refundable once delivered. The recipient receives the subscription duration as described at the time of purchase.
- Birdey includes virtual items such as bird cards, booster packs, and an in-game currency ("feathers"). Feathers can be earned through gameplay and spent on in-game items and features, for example in the Feather Shop or to recover a streak.
- Virtual items and feathers are licensed to you for use within the App, not sold. They have no real-world monetary value, cannot be exchanged for money, and are non-transferable outside the features we provide in the App.
- We may adjust, rebalance, add, or remove virtual items, feather prices, and earning rates as part of operating and improving the game.
- Virtual items and feathers are forfeited without compensation when your account is deleted or is terminated for violation of these Terms.
5. User Content
- You may upload a profile picture and submit content such as World First video links.
- You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free licence to display it within the App.
- You must not upload content that is illegal, offensive, or infringes on third-party rights.
- We may remove content that violates these Terms without prior notice.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose.
- Attempt to reverse-engineer, decompile, or tamper with the App or its servers.
- Exploit bugs or vulnerabilities to gain unfair advantages (e.g. duplicating cards, bypassing the weekly cap).
- Harass, abuse, or threaten other users through social features.
- Use automated scripts, bots, or scrapers to interact with the App.
7. Intellectual Property
All content in Birdey — including artwork, bird illustrations, text, audio, animations, and game mechanics — is the property of Bird's Odyssey or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
8. Third-Party Services
Birdey integrates with third-party services including Google Firebase, RevenueCat, Google Gemini AI, and the eBird taxonomy database. Your use of these services is subject to their respective terms and privacy policies.
9. Disclaimer of Warranties
Birdey is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Bird's Odyssey shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of or inability to use the App.
11. Termination
We may suspend or terminate your access to Birdey at any time for violation of these Terms. You may delete your account at any time from Settings → Delete Account within the App. Upon deletion all your data will be permanently removed as described in our Privacy Policy.
12. Changes to These Terms
We may update these Terms as the App evolves. Material changes will be communicated in the App. Continued use after changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of Denmark. Any disputes shall be subject to the exclusive jurisdiction of the courts of Denmark.
